Dans le monde entier, des victimes de l’amiante ont les yeux tournés vers l’Italie. Le procès qui se déroule depuis deux ans à Turin est historique.
Pour la première fois au monde, les responsable d’une tragédie sanitaire sans précédent auront des comptes à rendre à la Justice pénale. Pour la première fois ce ne seront pas des lampistes qui seront jugés, mais les plus hauts responsables du groupe Eternit, ceux qui élaboraient la stratégie criminelle de la multinationale de l’amiante-ciment, ceux qui en parfaite connaissance de cause ont minimisé le danger de ce matériau cancérogène et agi pour retarder son interdiction, en sachant que leurs profits auraient pour prix des milliers de vies brisées, les vies des ouvriers et des citoyens qu’ils n’avaient ni informés ni protégés.
Ce procès, c’est d’abord le résultat de 30 années de lutte. Saluons ici le courage et la ténacité de Bruno, Nicola, Romana qui incarnent et animent ce combat exemplaire. Nous leur donnons ici la parole pour en tirer les enseignements.
Si deux grands patrons ont été inculpés, si 20 ans de prison et plusieurs milliards d’euros de dommages et intérêts ont été requis contre eux, c’est aussi grâce à l’action du procureur Guariniello et de ses collaborateurs, qui ont su aller jusqu’au bout, sans craindre de viser très haut dans la recherche des responsabilités et de demander des peines à la hauteur des dommages commis.
Il est de la plus haute importance que les responsables de la tragédie internationale de l’amiante soient condamnés au pénal. Si les victimes le réclament, ce n’est pas par esprit de vengeance, c’est parce que nous voulons éviter que nos enfants subissent demain les terribles souffrances que milliers de familles ont vécues. C’est pour rappeler qu’il n’existe pas de permis de tuer dans les usines et que la recherche du profit ne doit pas passer avant le respect de la santé et de la vie.
Si les leçons de cette tragédie ne sont pas tirées, si les responsables ne sont pas sanctionnés, demain d’autres tragédies industrielles se reproduiront.
Les empoisonneurs doivent être jugés, en France comme en Italie. Les victimes françaises et leurs familles ne peuvent ni comprendre ni admettre que, 15 ans après les premières plaintes pénales, le procès qu’elles attendent toujours n’ait pas encore eu lieu.
Certes les mobilisations de l’Andeva et de ses associations locales ont permis de regrouper les plaintes au pôle de santé publique et d’obtenir quelques moyens supplémentaires. Certes des mises en examen ont été prononcées contre des chefs d’établissements et deux médecins du travail.
Mais les moyens des juges d’instruction restent insuffisants ; la chancellerie met des bâtons dans les roues ; elle fait tout pour retarder ce procès et en limiter la portée. Tout se passe comme si l’on craignait en haut lieu que la recherche de responsabilités n’éclabousse les pouvoirs publics et ne mette au grand jour des complaisances et des connivences avec les industriels poursuivis…
Le verdict du procès de Turin sera rendu avant la fin de l’année. Nous l’attendons en souhaitant que les peines prononcées soient les plus proches possibles des réquisitions. C’est un formidable espoir pour les victimes du monde entier.

Pourquoi une peine aussi lourde a-t-elle été requise contre
les dirigeants de la multinationale de l’amiante-ciment ?
Il est rare de voir 20 ans de prison requis contre un industriel.
Bruno : Ce qui est exceptionnel, c’est d’abord l’ampleur des dommages causés aux salariés et aux habitants de Casale.
Romana : Le procureur Guariniello a dit qu’il n’avait jamais vu « une tragédie aussi immense que celle de Casale ». Ce sont ses propres termes.
Nicola : Il a expliqué que durant toute sa carrière de juge il n’avait jamais été confronté à une catastrophe « qui a déjà causé la mort de plus de 3000 personnes et dont nous ne savons pas quand elle prendra fin ».
Il a relu tous les jugements de la cour de cassation dans lesquels étaient impliqués des industriels depuis quinze ans sans jamais trouver d’équivalent.
Le code pénal italien utilise le terme de catastrophe environnementale (disastro ambiantale).
Il n’est pas certain qu’existe un exact équivalent dans le code pénal français. Pouvez-vous expliquer ce que recouvre ce terme ?
Bruno : Il désigne des faits intérieurs et extérieurs aux entreprises, qui portent atteinte – ou sont susceptibles de porter atteinte – à la vie et à la santé des populations et de polluer l’air, la terre ou l’eau.
Une catastrophe environnementale peut être juridiquement constituée avant même que les dégâts ne se manifestent, notamment lorsqu’il s’agit de produits toxiques à effet différé.
Ce terme est en fait la qualification juridique de ce que le procureur a nommé « une immense tragédie ».
Comment le procureur a-t-il motivé les peines requises ?
Bruno : Il a réclamé vingt ans de prison contre Schmidheiny et de Cartier : douze ans pour conduite dommageable (condutta dolosiva) et huit ans pour conduite dommageable permanente (condutta dolosiva permanente).
Il leur est donc reproché non seulement d’avoir commis des actes délictueux qui ont causé et continueront à causer de terribles dommages aux Casalais et à leurs familles longtemps après la fermeture de l’usine, mais encore de les avoir commis en connaissance de cause, de façon manifestement planifiée et systématique.
Nicola : L’enquête du procureur de la République a démontré qu’il ne s’agissait pas d’actes isolés, ponctuels, sporadiques, mais d’une véritable stratégie du groupe Eternit, une stratégie qui s’est prolongée sur plusieurs décennies.
Ses dirigeants ont sciemment mis en danger la vie et la santé des salariés, mais aussi celles de tous les habitants de Casale, en diffusant des matériaux amiantés dans les maisons, les écoles, les jardins d’enfants…
Ils ont sciemment mis en danger les épouses qui lavaient les bleus de travail couverts de poussières d’amiante que les ouvriers ramenaient à la maison parce qu’Eternit n’assurait pas leur lavage.
Lorsque l’usine de Casale a fermé ses portes, ils l’ont abandonnée en l’état, avec ses plaques de fibrociment et ses sacs de poudre d’amiante, sans protection ni contrôle, laissant n’importe qui y pénétrer.

Victims of asbestos throughout the world are turning their attention to Italy. The trial which has been taking place in Turin for two years is a first.
For the first time ever the people responsible for a health disaster without precedent will have to account for their actions in a court of justice. For the first time it will not be underlings who will go to trial but the most senior executives of Eternit, those who elaborated the criminal strategy of the multinational of asbestos-cement, those who knowing full well the effects of this carcinogenic material, tried to delay its interdiction and put profits first at the cost of thousands of lives, the wasted lives of workers and citizens who had no information and no protection.
This trial is the result of 30 years of fight. Let us honour the courage and obstinacy of Bruno, Nicola and Romana who epitomize this hard fought battle. We will give them voice to tell us the lessons learnt.
If two senior executives have been indicted, if 20 years in prison and several billions of Euros in damages are requested, it is also thanks to the prosecutor Guariniello and his collaborators who managed to see it to the end, unafraid to aim high in their search for the people responsible and who requested sentences appropriate to the level of their crimes.
It is of the highest importance that the people responsible for this asbestos tragedy of international importance be condemned in a court of justice. If the victims demand it, it is not for vengeance but because they want to avoid their children going through the same terrible sufferings as thousands of families had to. It is to recall that there is no killing permit in industrial plants and that the search for profit must not go before the sanctity of health and life. If we do not draw lessons from this tragedy, if the people responsible are not punished, tomorrow more industrial accidents will happen.
The poisoners must be put on trial in France as well as in Italy. The French victims and their families can neither understand nor accept that 15 years after the first criminal complaints, the trial which they are waiting for, has still not taken place.
The mobilisation of Andeva and the local associations has allowed the grouping of complaints at the centre of public health and to obtain extra funding. There have been some indictments against plant managers and two occupational doctors.
But the means of the judges remain insufficient: the Ministry of Justice is impeding progress; it is doing its utmost to delay this trial and minimise its scope. It is as if people in high places feared that the search for responsibilities might splatter the public authorities and might show up complacencies and collusions with the industrialists on trial.

Why was such a long sentence requested for the executives of the multinational of asbestos-cement?
It is rare to hear a 20-year sentence requested against an industrialist.
Bruno: What is exceptional is first the size of the damages caused to the employees and the inhabitants of Casale.
Romana: The prosecutor said he had never seen “a tragedy of such proportions as that of Casale”. Those were his own terms.
Nicola: He explained that during his whole career he had never been confronted with a tragedy ”which had already caused the death of more than 3000 people and which has no end in sight.”
He read again all the decisions of the Court of Cassation in which industrialists were involved in the last 15 years without finding any equivalent.
The Italian penal code uses the term environmental catastrophe (disastro ambiantale). I am not sure that such a term exists in the French penal code. Could you explain what this term encompasses?
Bruno: it applies to business factors, external and internal, which harm (or could potentially harm) the life and health of people, pollute the air, the earth or the water.
An environmental catastrophe can be legally established even before the damage is visible, notably when it involves toxic products with a delayed effect.
This is in fact the legal term for what the prosecutor called “an immense tragedy”.
How did the prosecutor justify the sentences requested?
Bruno: he requested 20 years in prison for Schmidheiny and de Cartier: twelve years for harmful conduct (condutta dolosiva) and eight years for permanent harmful conduct (condutta dolosiva permanente).
They are accused not only of having committed criminal acts which caused and will continue to cause terrible harm to the people of Casale and their families long after the closure of the plant, but also of having committed them knowingly, in a systematic and planned manner.
Nicola: the investigation of the public prosecutor showed that these were not one-off actions, isolated and sporadic, but were the result of an actual strategy from the Eternit Group, a strategy that was applied over several decades.
Its executives knowingly endangered the life and health of their employees as well as that of all the inhabitants of Casale by allowing asbestos materials in houses, schools, nursery schools…
They knowingly put in danger the wives who washed the overalls covered in asbestos dust which the workers had to bring home because Eternit didn’t take on their cleaning.
When the plant in Casale closed, they left it as it was, with its asbestos-cement sheets and its bags of asbestos dust, with no barriers or control, allowing anyone to get in.

Source text - English 5. COPING AND SURVIVAL MECHANISMS
Some of the women without a regular form of income relied on a range of work as beauticians, manicurists and pedicurists, hairdressers and launderers. But these activities brought them half the revenues they would have earned under normal circumstances before the earthquake. The desperation that these women find themselves-in put them in disadvantaged negotiating positions. The increased supply of women offering similar services was also blamed.
Faced with lack of income, parents look to child labor for the family to cope and survive. Young girls are entrusted by their families as domestic servants “restavèk”, in exchange for food and shelter (although this had been a common practice in destitute families even before the earthquake). The women said it is becoming hard to find families who could receive this kind of offer since the crisis. Boys left alone, without their parents or carers, resort to petty crime and activities like begging. In the absence of viable economic activities and employment, women were dragged into prostitution and encouraged their daughters to exchange sex for food, money and other forms of assistance.
Before the earthquake, certain financial mechanisms used to assist women to start up economic activities and gain capital assets. These mechanisms are facing difficulties and are also failing. They include:
Placer and Escompte: in the first case, women leave household items as warranty to guarantee the repayment of money they borrow to start up a small business, to feed their families, to pay schooling for their children, and to cope with sudden changes in their expenditures. These items are supposed to be returned upon repayment.
The second one involves borrowing money for the same sort of needs. However, in this second type of arrangement, money is borrowed with interest rates as high as 80%, which most women are unable to keep up with.
The unpaid debts implied loss of their limited resources, sinking deeper into a vicious circle of borrowing and poverty. This has had an impact on health and further deteriorated their psychosocial status. Increased levels of worry, stress, depression, living in fear and absence of security due to threats from lenders are among the health related consequences mentioned.
Community rotational financial collection: This type of community financial support system is the most favored amongst women. However the losses in livelihoods and employments had recently meant that such schemes are increasingly rare. Under normal conditions such schemes are often used to buy assets such as land, and to start small businesses. Now, they have become a means to meet the cost of day to day life. Since the money collected does not allow being productive women struggle to repay.
Other means and mechanisms included selling household items, reducing or abandoning consumption of some food items and replacing them with others not consumed before (mud cake for bread, new plants and leaves replacing vegetables such as spinach and cabbage).
Symbiotic social support systems, extended families and religious beliefs (God) were also mentioned as key sources of strength and consolation.

Un certain nombre de femmes sans salaire régulier comptaient sur une gamme d’emplois comme esthéticienne, manucure et pédicure, coiffeuse et blanchisseuse. Cependant ces activités leur rapportent la moitié des salaires qu’elles auraient gagnés dans des circonstances normales avant le tremblement de terre. La situation désespérée dans laquelle se trouvent ces femmes les met en position défavorable pour négocier. Une autre raison est le nombre accru de femmes offrant les mêmes services.
Confronté à un manque de revenus, les parents se tournent vers le travail des enfants pour arriver à se débrouiller et survivre. Des jeunes filles sont placées par leur famille comme domestiques « restavèk » en échange de nourriture et d’abris (même si c’était déjà une pratique courante dans les familles les plus démunies avant le tremblement de terre). Les femmes disent que depuis la crise cela devient difficile de trouver des familles qui peuvent accepter ce genre d’arrangement. Les garçons laissés seuls, sans parents ni aide familiale, ont recours à la délinquance et à la mendicité. En l’absence d’activités économiques viables et d’emploi, les femmes ont été entrainées dans la prostitution et ont encouragé leurs filles à échanger des rapports sexuels en échange de nourriture, d’argent ou d’aide sous d’autres formes.
Avant le tremblement de terre, certains mécanismes financiers aidaient les femmes à se lancer dans une activité économique et à obtenir des actifs immobiliers. Ces mécanismes font face à des difficultés et sont en faillite. Ils comprennent :
Placer et Escompte : dans le premier cas, les femmes donnent des articles ménagers comme garantie pour assurer le remboursement de l’argent qu’elles empruntent pour établir une petite entreprise, nourrir leurs familles, payer l’éducation de leurs enfants, et pour faire face aux dépenses inattendues. Ces articles sont censés leur être rendus quand elles ont fini de rembourser.
Le deuxième mécanisme consiste à emprunter de l’argent pour les mêmes types de besoins. Cependant, dans ce deuxième type d’arrangement, l’argent est emprunté à un taux d’intérêt aussi élevé que 80%, ce que la plupart des femmes sont incapable de suivre.
Les dettes impayées impliquent la perte de leurs ressources limitées, et les plongent dans un cercle vicieux toujours plus profond d’emprunt et de pauvreté. Cela a eu un impact sur la santé et a aussi entrainé un déclin de leur statut psychosocial. L’accroissement des niveaux de soucis, de tension, de dépression, d’une vie dans la crainte et l’absence de sécurité dues aux menaces des prêteurs fait partie des conséquences liées à la santé dont nous avons parlé.
La perception financière communautaire en rotation : ce type de système de support financier communautaire est le plus favorisé des femmes. Néanmoins les pertes de salaires et d’emplois récents veulent dire que de tels projets sont de plus en plus rares. Dans des conditions normales on utilise souvent de tels projets pour acheter des biens comme une propriété et commencer des petites entreprises. Maintenant, ils sont devenus un moyen de faire face aux dépenses de la vie quotidienne. L’argent reçu ne permettant pas aux femmes d’être productives, elles ont du mal à rembourser.
D’autres mécanismes comprenaient la vente d’articles ménagers, la réduction ou l’abandon de la consommation de certains aliments en les remplaçant par d’autres que l’on ne consommaient pas auparavant (gâteau de boue à la place du pain, de nouvelles plantes et feuilles remplaçant les légumes comme les épinards et les choux).
Les systèmes symbiotiques de support social, les familles élargies et les croyances religieuses (Dieu) sont également mentionnés comme sources de force et de consolation.
