La taxe qui prévoit de prélever 3 % du chiffre d’affaires des géants du numérique est d’autant plus légitime et nécessaire que partout dans le monde, y compris aux Etats-Unis, la puissance de ces groupes inquiète.
La France a beau être l’un des champions mondiaux des prélèvements obligatoires, parfois, la création d’un impôt peut se révéler pertinente. C’est le cas de la taxe sur le numérique adoptée le 11 juillet par le Parlement, n’en déplaise à Donald Trump.
Cette initiative, qui vise à déjouer les stratégies d’optimisation fiscale des géants de l’Internet en prélevant 3 % de leur chiffre d’affaires réalisé en France, a provoqué l’irritation des Etats-Unis.
Washington a lancé une procédure visant à déterminer si cette taxe est « discriminatoire ou déraisonnable « et « entrave ou restreint le commerce des Etats-Unis », laissant planer la menace d’éventuelles rétorsions commerciales.
Non seulement cette taxe GAFA est légitime et nécessaire, mais les Etats-Unis sont mal placés pour donner des leçons de fair-play, alors que leur président s’est lancé dans une guerre commerciale tous azimuts aussi inutile que dangereuse.

Il faudrait être aveugle ou d’une rare mauvaise foi pour ne pas admettre que la taxation des entreprises a besoin d’une profonde réforme pour s’adapter à l’ère numérique. Depuis des années, grâce à des artifices comptables et à des cascades ingénieuses de filiales basées dans des pays aux taux d’imposition attrayants (Irlande, Luxembourg), ces géants de l’Internet délocalisent systématiquement leurs profits en créant une déconnexion entre l’activité générée et les bénéfices déclarés localement. Les GAFA (Google, Amazon, Facebook, Apple) paient ainsi en moyenne deux fois moins d’impôts que les entreprises traditionnelles.
Paris pas isolé dans cette bataille
Contrairement à ce qu’insinue Washington, il ne s’agit pas d’un contentieux entre la France et les Etats-Unis. D’abord, parce que cette taxe touchera également des entreprises européennes et même françaises. Ensuite, Paris n’est pas isolé dans cette bataille. Le Royaume-Uni vient également de présenter un projet de loi pour instaurer une taxe de 2 % sur le chiffre d’affaires des géants du Web, tandis que l’Espagne, l’Italie, l’Autriche, la Belgique et l’Australie se sont engagées dans des initiatives similaires. La pression est telle que le sujet devrait être inscrit à l’ordre du jour de la prochaine réunion des ministres des finances du G7 les 17 et 18 juillet à Chantilly, puis à celle des chefs d’Etat du G7 de Biarritz, fin août.
Contrairement à ce que soupçonne Donald Trump, il ne s’agit pas d’ouvrir un nouveau front commercial, mais plutôt de trouver un consensus international pour enfin instaurer une fiscalité équitable. Le fait que l’Union européenne (UE) ait récemment échoué à trouver un accord sur le sujet – le Danemark, l’Irlande, la Suède et la Finlande s’y étant opposés – ne signifie pas que Bruxelles doit renoncer à avancer sur cette question, mais simplement que, une fois de plus, la règle de l’unanimité n’est plus adaptée au fonctionnement efficace du projet européen.
A qui Donald Trump va-t-il faire croire que l’initiative française est discriminatoire, lui qui, ces derniers mois, a multiplié les relèvements de droits de douane au mépris des règles de l’Organisation mondiale du commerce, tandis qu’il organisait un véritable dumping fiscal pour rapatrier les profits réalisés par ces mêmes GAFA au détriment des recettes fiscales des Etats membres de l’UE ? Partout dans le monde, y compris aux Etats-Unis, la puissance des géants du numérique inquiète. Qu’il s’agisse de concurrence ou de fiscalité, il est temps qu’ils jouent avec les mêmes règles que les autres entreprises.

The tax that plans to take three percent of these digital giants’ revenue is more crucial and reasonable now than ever as countries all over the world, including the United States, grow concerned about the power of these groups.
France may well be one of the world’s leading imposers of compulsory levies, but sometimes introducing a tax may be the most appropriate thing to do. Enter the digital tax adopted by Parliament on July 11th. (Sorry, Trump.)
The initiative, which aims to thwart the tax optimization strategies of Internet giants by deducting three percent of their turnover in France, caused alarm in the United States. Washington has initiated a process to determine whether the tax is "discriminatory or unreasonable" and "impedes or restricts US trade", leaving the threat of possible trade retaliation.
Not only is this GAFA tax legitimate and necessary, but the United States is in no position to preach about fair play, when its president has embarked on an all-out trade war that is as useless as it is dangerous.
You’d have to be blind or deliberately obtuse not to admit that company taxation needs deep reform to adapt to the digital age. For years, thanks to the accounting tricks and ingenious exploits of subsidiaries based in countries with attractive tax rates (Ireland, Luxembourg), these Internet giants have been systematically relocating their profits by creating a disconnect between their economic activity and their locally declared profits. GAFA companies (Google, Amazon, Facebook, Apple) pay on average half as much tax as traditional companies.
Paris is not alone in this battle
Contrary to what Washington suggests, this is not a dispute between France and the United States. For a start, because this tax will affect European and also French companies. So, Paris is not alone in this battle. The UK has also just introduced a bill to introduce a two percent tax on web giants’ turnover, while Spain, Italy, Austria, Belgium and Australia have engaged in similar initiatives. The mounting pressure has led to the issue being placed on the agenda of the next meeting of G7 finance ministers on the 17th and 18th of July in Chantilly, and at the meeting of the heads of state of the G7 Biarritz in late August.
Contrary to what Donald Trump suspects, it is not a question of opening a new trade front, but rather of reaching an international consensus to finally establish a fair tax system. The fact that the European Union (EU) has recently failed to reach an agreement on the subject - Denmark, Ireland, Sweden and Finland opposed it - does not mean that Brussels must give up on this issue, but simply that, once again, the rule of unanimity is acting as a hindrance to the effective functioning of the European project.
Who will Donald Trump try to convince that this French initiative is discriminatory? The same Trump who has violated the rules of the World Trade Organization by increasing tariffs, while also fiscal dumping to repatriate the profits made by these same GAFA companies, harming the tax revenues of EU member states in the process. Countries all over the world, including the United States, are growing increasingly concerned about the power of these digital giants. Whether it's competition or taxation, it's time for them to play by the same rules as other companies.
