Shawe makes points about how the law isn't really a fit for translators, since many juggle multiple gigs from multiple employers. He also wonders whether it could make the US less competitive than other countries where vendors are located.

How does this new law affect agencies in California? Can they hire freelancers outside of California or are they basically now limited to using employees only?

The unfortunate part of all this is that it looks like Uber and Lyft, the companies at the impetus of this new law, are using work-arounds to continue business as usual.

There was a similar unwritten "law" in place nationwide in 1993 when I started translating where in order to show you were an independent contractor, you could not work more than 20% for any one agency.

I have one Cali client, and they still work with me. They told me that they're unable to keep their Californian freelancers, due to AB5. Many agencies across the country have also dropped all their Cali freelancers. They are in a dire situation, and many have been without any income since the beginning of this year. However, a similar bill has passed the House (H.R.2474, aka the "Pro Act"). It will not pass the Senate as long as the GOP has a majority there (and it can be vetoed by the president as well), however, it's just a question of time before we all have to deal with this, I am afraid.....the unions are powerful.....

And you are correct. It all started with Uber and Lyft, after the Supreme Court (2018) ruling against a company called Dynamex.

It's a shame that legislators classify us (and other highly educated professionals who are independent contractors by choice) as "gig workers" who need protection. I don't see myself as misclassified.
