Source text - French 5. Les contrats de travail et accords de collaboration
En fonction du pays dans lequel nous intervenons, différents types de contrat de travail peuvent exister. Nous reprendrons ici les plus fréquents.
La législation en vigueur est particulièrement importante dans la définition de la politique contractuelle. En effet, même si les types de contrats peuvent plus ou moins être communs à certains pays, leur contenu et les obligations afférentes sont, elles, différentes d’un pays à un autre.
Nous mettrons en avant ici les points particuliers à prendre en compte dans l’établissement d’un contrat de travail.
Contrat à durée déterminée (CDD)
Bien souvent, il s’agit comme son nom l’indique d’un contrat qui établit une relation de travail pour une durée précise. Parfois, le contrat peut aussi être à termes imprécis (appelé contrat à la tâche dans certains pays) et il est lié à la réalisation d’une tâche clairement définie. Le contrat peut généralement prendre fin dans des conditions très spécifiques, à vérifier selon la loi du travail de chaque pays. A titre indicatif, en France, on peut rompre un CDD que dans de rares conditions : accord à l’amiable, si l’employé à trouver un emploi en CDI, faute grave (de l’employeur ou de l’employé) et force majeure.
Pour ce type de contrat, il faut particulièrement faire attention à :
Les conditions d’utilisation : dans certains cas, l’utilisation d’un CDD n’est pas acceptée par la loi (par exemple, en France, un contrat de travail à durée déterminée, quel que soit son motif, ne peut avoir ni pour objet ni pour effet de pourvoir durablement un emploi lié à l'activité normale et permanente de l'entreprise) ;
La durée du contrat : par exemple, dans certains pays, un CDD ne peut être conclut pour une durée supérieure à 2 ans ;
Le renouvellement du contrat : parfois, il n’est pas possible de faire plus de deux CDD pour une même personne sur un même poste ;
La durée de la période d’essai : souvent plus courte que pour un CDI par exemple ;
Les indemnités à payer à l’employé en fin de contrat ;
Le reclassement d’un CDD en CDI peut être fréquent : un employé continu à travailler au-delà de la date de fin de CDD, une mauvaise utilisation du CDD…
Une indemnité de fin de CDD peut être prévue par la législation nationale : d’un point de vue financier, se référer à la procédure administrative de provision de ces indemnités.
Contrat à durée indéterminée (CDI)
Le CDI est généralement utilisé pour les postes pour lesquels il existe une bonne visibilité et l’on sait que ce n’est pas dû à un accroissement temporaire d’activités par exemple. L’employé est donc sous contrat pour une durée imprécise. Le contrat peut prendre fin à l’initiative de l’employé (démission), de l’employeur (licenciement économique, disciplinaire…), par consentement mutuel, décès, etc. Comme pour le CDD, la rupture d’un CDI suit des règles et procédures très précises (variables selon le code du travail).
Pour ce type de contrat, il faut particulièrement faire attention à :
La durée de la période d’essai et les modalités de rupture de cette période: généralement, celle-ci peut être renouvelable avec information écrite, vérifier si préavis nécessaire pour la rupture ;
Les motifs de rupture : par exemple, dans le cadre d’une fermeture de mission, ou d’une réorganisation d’équipe, quelles modalités ?
Les indemnités à payer à l’employé en fin de contrat : elles doivent être provisionnées selon la procédure administrative XXX en vigueur.
La convention de bénévolat :
La convention de bénévolat établit une collaboration entre le bénévole et l’organisation soit pour une durée précise, soit pour un ensemble de tâches. Bien qu’il ne puisse prétendre à aucune rémunération ni prime en contrepartie de son activité, le bénévole s’engage à respecter un certain nombre de « règles » à l’instar de n’importe quel salarié, telles que des horaires prédéfinis, les liens de hiérarchie, les règles de sécurité etc. La convention prend fin à la date mentionnée sur la convention ou avant, sur initiative du bénévole (raisons personnelles, professionnelles ou familiales) ou de l’employeur (toutes raisons liées au bon fonctionnement des services).
Le contrat de consultant:
Ensemble des prestations accomplies et présumées être effectuées en toute indépendance. Il est conclu pour une durée précise ou pour un ensemble de tâches. La condition préalable pour conclure un tel contrat est que la personne possède un numéro de SIREN. Nous versons une rémunération brute et les consultants sont responsables de leurs déclarations. Chaque mois, ils présentent à XXX une facture en contrepartie de laquelle nous les payons, celle-ci ne pouvant excéder un montant annuel de 34 000€.
Ce type de collaboration n’est en aucun cas assimilable à un contrat de travail, XXX n’est pas l’employeur.
Les CDD et CDI pour les non ressortissants de l’Union Européenne (UE) qui travaillent hors UE
Il s’agit de CDD et de CDI de droit français que nous utilisons pour les personnes n’ayant pas la nationalité française et/ou pas de numéro de sécurité sociale français. Les principes sont les mêmes, la différence résidant sur le fait qu’en tant qu’employeur nous ne sommes pas en mesure de mettre à jour les cotisations sociales pour ces salariés. Par conséquent, nous leur versons une rémunération brute et ils sont responsables de se mettre à jour de leurs cotisations avec les autorités compétentes dans leur pays de résidence.
Les stages
Tous les stages sont gérés à travers des conventions de stage, entre l’établissement de l’étudiant, XXX et l’étudiant.
Pour tout stage de plus de 2 mois, l’indemnité de stage obligatoire minimale est de 508.20€/mois (mai 2015). Par conséquent, un stagiaire international perçoit une indemnité de stage de ce montant, celui-ci représentant également la limite maximale avant soumission à cotisations sociales. De plus, les stagiaires internationaux de Dakar perçoivent une indemnité de transport sur place. Il bénéficiera de 2.5 jours ouvrables de break par mois. Si ceux-ci ne sont pas pris, XXX n’est pas dans l’obligation de rémunérer ces jours de break, ceux-ci étant un avantage fourni, et non une obligation légale. XXX ne prend pas en charge financièrement ce break, mais maintiendra la gratification du stagiaire pendant ces jours. Le billet d’avion pour venir de son pays d’origine au Sénégal est pris en charge par XXX.
Un stagiaire en mission sur le terrain perçoit également l’indemnité de stage. Il percevra un perdiem pendant la durée de sa mission et XXX prendra en charge son logement et il pourra bénéficier d’un break selon la politique de break, qui sera pris en charge par XXX (mais n’accumule pas de congés payés).
Les accords de collaboration
Dans certains pays, nous sommes amenés à travailler en collaboration avec d’autres structures. Il s’agit principalement du Ministère de la Santé. En effet, il est possible que dans une structure XXX des employés du Ministère de la Santé soient déjà présents et qu’il soit décidé de continuer à travailler avec eux. Dans un tel cas, leur employeur reste le Ministère de la Santé. Il faut néanmoins formaliser la relation de collaboration et cela passe par un accord de collaboration. Celui-ci est déterminé directement selon le protocole d’accord entre XXX et cette entité. Par conséquent, les conditions de collaboration et de prise en charge varient selon le protocole.
Néanmoins, dans tous les cas, le point clé de cette relation est qu’XXX n’est pas l’employeur de ces personnes. Par conséquent, ce n’est pas la même prise en charge que pour les employés. XXX n’étant pas l’employeur, la relation n’est pas définie par la loi du travail. Les obligations, tant de XXX que du collaborateur vis-à-vis de l’employé ne sont pas les mêmes. La rémunération éventuellement perçue n’est pas un salaire mais une indemnité. De même, XXX ne s’engage pas à verser cette indemnité directement au collaborateur mais, selon le protocole, ces indemnités peuvent être versées au responsable du Ministère de la Santé qui a la charge de partager ces indemnités à ses employés. Il est néanmoins essentiel de prévoir le rôle et les responsabilités d’XXX dans le recrutement et l’arrêt de la collaboration avec ces personnes au moment de la rédaction des MOU ou accord avec les structures.
Les journaliers
Par définition, ceux-ci n’ont pas de contrat de travail écrit. En revanche, il faut être particulièrement vigilant car dans la plupart des pays une législation est en place concernant le travail des journaliers et un certain nombre d’obligations sont à respecter (durée d’emploi comme journalier maximum par exemple) sous peine de voir un journalier requalifié comme étant sous contrat de travail. De plus, de par la nature et la précarité d’un tel accord, l’emploi de journalier doit être spécifiquement limité non seulement dans le temps mais en termes de recours : pour les urgences, pour une tâche exceptionnelle etc.
Le montant du salaire journalier sera déterminé sur base de la grille de salaire en vigueur sur le projet.
Translation - English Employment Contracts and Collaborative Agreements
Depending on the country in which we are operating, different types of work contract can exist. Here we cover the most common ones.
The legislation in force is particularly important in defining contract policy. Indeed, although types of contract may be more or less common across some countries, their contents and duties are different from one country to another.
Fixed Term Contract
This is very often, as its name suggests, a contract which establishes a working relationship for a specific period of time. Sometimes, the contract can also be for an unspecific period of time (called a task type contract in some countries) and is linked to the completion of a clearly define task. The contract can generally be ended in very specific conditions, to be checked according to the employment law of each country. As an example, in France a Fixed Term Contract can only be broken in unusual circumstances: amicable agreement, if the employee has found a permanent contract, misconduct (by the employer or the employee) and force majeure.
For this type of contract, particular attention must be paid to:
• Conditions of use: in some instances, the use of a Fixed Term Contract is not accepted by law (for example, in France, whatever the grounds for a fixed term contract, it cannot, by purpose or effect, be used to extend a post which forms part of the standard and permanent activity of the organisation;
• The duration of the contract: for example, in some countries, a Fixed Term Contract cannot be agreed for a duration of more than 2 years;
• Contract renewal: sometimes, it is not possible to enter into more than two Fixed-Term Contracts for the same person in the same position;
• Duration of the trial period: for example, it is often shorter than for a Permanent Contract;
• Compensation to be paid to the employee at the end of the contract;
• The conversion of a contract from Fixed Term to Permanent can be frequent: if an employee continues to work beyond the end date of his Fixed Term Contract, this shows a poor choice of contract type
• Compensation at the end of a Fixed Term Contract may be dictated by national legislation: from a financial point of view, refer to the administrative procedure for the processing of this compensation
Permanent Contract
The Permanent Contract is usually used for long-term posts and it is known, for example, that it has not arisen due to a temporary increase in activity. The employee is therefore under a contract for an unspecified period of time. The contract can end on the initiative of the employee (resignation), the employer (redundancy, dismissal…), by mutual consent, death, etc. As for a Fixed Term Contract, ending a Permanent Contract follows rules and regulations (based on employment law).
For this type of contract, particular attention must be paid to:
• The duration of the trial period and the procedures to terminate a contract during this period: generally, the trial period can be renewable, if it is in writing; check whether notice is required to terminate it;
• Reasons for termination: for example, in the case of the end of a mission, or team re-organisation, what are the terms?
• Compensation payable to the employee at the end of the contract: this must be funded according to the relevant XXX administrative process.
Voluntary Agreement
A Voluntary Agreement establishes an agreement between the volunteer and the organisation, either for a specific period of time, or for a specific activity. Although he cannot claim any payment or allowance for his work, the volunteer undertakes to respect a certain number of “rules” just like any employee, such as predefined working hours, lines of authority, Health & Safety rules, etc. The Agreement ends on the date written in the Agreement or before, by the volunteer (for personal, professional or family reasons) or by the employer (for any reason linked to the smooth running of the service).
Consultancy Contract
A set of services carried out or deemed to have been carried out entirely independently. It is agreed for a specific duration or for a group of tasks. The prerequisite to agree this type of contract is that the person has a SIREN number (unique French business identification number ≈ company registration number). We make a gross payment and the consultants are responsible for their own tax returns. Each month, they present XXX with an invoice against which we pay them, up to an annual sum of 34 000€.
This type of agreement is in no way similar to an employment contract, as XXX is not the employer.
Fixed Term and Permanent Contracts for non-European Union (EU) Citizens who work outside the EU
When we use French legal Fixed Term and Permanent Contracts for people who do not have French nationality or a French social security number, the principles are the same. The difference is the fact that, as the employer, we are unable to make contributions for these employees. Consequently, we pay them a gross sum and they are responsible for making their payments to the appropriate authorities in their country of residence.
Internships
All internships are managed by training agreements between the educational establishment, XXX and the student.
For any internship lasting more than 2 months, the minimum mandatory payment is 508.20€ / month (May 2015). Therefore an international intern receives this amount of pay, which also represents the maximum limit before payroll taxes are payable. Moreover, international interns from Dakar receive a travel allowance locally. The intern gets 2.5 days off per month. If these are not taken, XXX is not obliged to pay these rest days, as these are a benefit provided and not a legal obligation. XXX does not meet the costs of these days off but will maintain the intern’s gratuity for these days. The flight for students from Senegal is paid for by XXX.
An intern on a field mission also receives payment. He will earn a per diem rate for the duration of the mission. XXX will meet the costs of his accommodation and he will be granted a break according to the break policy, which will be covered by XXX (but paid holidays cannot be accumulated).
Collaborative Agreements
In some countries, we are obliged to work in collaboration with other facilities, mainly belonging to the Department of Health. Indeed, it is possible that Department of Health employees are already present within an XXX facility and that they decide to continue to work with them. In this case, the employer remains the Department of Health. Nevertheless, this collaborative relationship must be formalised by the creation of a Collaborative Agreement. This is defined directly by the protocol agreement between XXX and the entity in question. Therefore, the conditions and management of the collaboration vary from protocol to protocol.
However, in all cases, the key point about this relationship is that XXX is not the employer of these people. Therefore, there is not the same management as for employees. As XXX is not the employer, the relationship is not defined by employment law. The obligations of XXX as the employee’s collaborative partner are not the same. Any payment made is not a salary, but an allowance. Also, XXX does not undertake to pay this allowance directly to the worker but, depending on the protocol, allowances may be paid to the person within the Department of Health who has the responsibility for distributing these allowances to the employees. It is nevertheless essential to define the role and responsibilities of XXX in the recruitment and at the end of the collaboration with these people when creating the Memorandum of Understanding (MOU) or Agreement with these facilities.
Casual Labour
By definition, casual labour does not have a written contract. However, particular care is required because most countries have legislation in place concerning casual labour and there are a certain number of obligations to be respected (for example maximum duration that a person can work for and still be classed as “casual labour”) at the risk of seeing a casual worker reclassed as being under a contract of employment. Moreover, due to the nature and the insecurity of such an agreement, the work of the casual worker must be specifically limited, not only in time but in terms of when it is resorted to: for emergencies, for a special task, etc.
The amount of the casual pay will be based on the current salary scale for that project.

I only translate into my native language, which is English. I work with both agencies and direct clients. Whilst I generally advocate shorter lines of communication, I always strive to develop a positive relationship with all stakeholders and I know that excellent communication is key, especially on larger projects. First, I take time to understand exactly what your desired outcomes are. For smaller pieces of work, this might just mean that I read all your instructions. For larger projects, I ask the relevant questions and listen to your requirements. Then I can propose creative solutions as the need arises. I communicate regularly to keep you informed of progress on all longer-term projects and, of course, I get in touch immediately if any problem arises, no matter how small. I proofread everything I translate, so I prefer next-day delivery but I appreciate that some jobs will be more urgent and I work flexible hours to ensure I meet deadlines.
