Source text - Spanish Diariojudicial.com publica el fallo de la Corte Suprema de Justicia de la Nación que ordenó el ajuste del haber jubilatorio de un particular. Se trata de la causa “Badaro, Adolfo Valentín contra ANSeS sobre reajustes varios” en la que además el Máximo Tribunal declaró la inconstitucionalidad del art. 7, inciso 2, de la ley 24.463 y exhortó al Congreso a que dicte una ley que regule las pautas que garanticen la movilidad de los haberes jubilatorios. La Corte Suprema de Justicia de la Nación determinó que las jubilaciones deben ser móviles y por ello ajustarse según los índices anuales de salarios, valores publicados por el Instituto Nacional de Estadística y Censos (INDEC), etc. Para ello le otorgó la obligación del pago del nuevo haber, retroactividades e intereses a la Administración Nacional de la Seguridad Social (ANSeS).
El Tribunal entendió que si bien le correspondía al Congreso de la Nación “fijar los incrementos mediante las leyes de presupuesto” debía ser considerado que no había cumplido con ello hasta el año 2006, y que
“esa omisión había producido, a partir de la crisis del año 2002, un severo deterioro en las condiciones de
vida del apelante”.
Para llegar a dicha decisión, los jueces realizaron una reseña de los últimos aumentos generados en los haberes jubilatorios. Además, consideraron el hecho de que los decretos de necesidad y urgencia dictados por el Poder Ejecutivo en la materia, habían otorgado aumentos, pero no habían subsanado la merma sufrida en los beneficios superiores a $ 1.000. Por ello, entendió la Corte que el aumento resultaba insuficiente para reparar el deterioro en el patrimonio del recurrente.
Así concluyeron que se verificaba en el caso una lesión a la garantía prevista en el art. 14 bis de la
Constitución Nacional, ya que “la prestación no había sido acompañada en el transcurso del tiempo y
reforzada a medida que perdía la razonable relación que debía mantener con los ingresos de los trabajadores”.
Por otro lado, el Tribunal ordenó que la ANSeS debía ser quien abonara el nuevo haber y las retroactividades que surjan de la liquidación correspondiente, estas últimas más los intereses según el precedente del fallo “Spitale”.
Por último, la Corte consideró que contribuiría a dar mayor seguridad jurídica el dictado de una ley que estableciera pautas de aplicación permanentes que aseguren el objetivo constitucional. A su vez, contar con una reglamentación prudente de la garantía en cuestión, permitiría reducir la cantidad de litigios en esta materia. En tal sentido, el Congreso dictó una ley sobre el tema pero la Corte explicó al respecto que para el caso debía aplicarse un criterio objetivo (el índice de salarios, nivel general) para dar seguridad jurídica a los jubilados. Así, el Máximo Tribunal resolvió declarar en el caso la inconstitucionalidad del art. 7, inc. 2, de la ley 24.463, y disponer que la prestación del recurrente se ajuste, a partir del 1º de enero de 2002 y hasta el 31 de diciembre de 2006, según las variaciones anuales del índice de salarios, nivel general, elaborado por el INDEC, lo que significa un aumento aproximado del 88%.
Cabe mencionar que si bien la sentencia judicial se aplica únicamente al caso, los demás jubilados que hayan iniciado juicio y estén en condiciones similares, podrán invocar el mismo criterio.
Translation - English Diariojudicial.com publishes the ruling from the Argentinean Supreme Court of Justice that ordered the adjustment of an individual's retirement pensions. In the case “Badaro, Adolfo Valentín v. In reaching that decision, the judges conducted a review of recent increases in retirement pensions. They also considered the fact that the decrees of necessity and urgency issued by the Executive Branch in the matter, had granted increases, but had not remedied the decline in benefits higher than ARS 1,000. Therefore, the Court found the increase to be insufficient to repair the damage to the appellant’s assets.
Thus it was concluded that there had been a verified breach of the guarantee set forth in Art. 14 bis of the Constitution, since “the benefit had not been accompanied over the course of time or secure as it lost the reasonable relationship that it should have maintained with the workers’ incomes.”
Furthermore, the Court ordered that the National Social Security Administration (ANSeS) should be responsible for paying the new benefit and the retroactive payments that arise from the corresponding settlement, the latter plus interest according to the “Spitale” ruling.
Finally, the Court held that the passing of a law establishing permanent application guidelines that ensure the constitutional objective would help provide greater legal security. In turn, having prudent regulation of the guarantee in question would reduce the amount of litigation in this matter. To this effect, the Congress passed a law on the subject but the Court explained that in this case an objective criterion (the general wage index) should be applied to provide legal security to retirees.
Thus, the highest court declared the unconstitutionality of Art. 7, paragraph 2, of Law 24.463, and ordered that the benefit of the appellant be adjusted, from January 1, 2002 until December 31, 2006, according to the annual overall variations of the wage index, prepared by the INDEC, which reflects an approximate increase of 88%.
It should be mentioned that while the court ruling only applies to this case, other retirees who have begun litigation and are in similar situations, may invoke the same standard.

que las palabras y conceptos técnicos que no hayan sido expresamente definidos, deberán entenderse en su sentido natural, según su significado comúnmente aceptado en la rama de la ciencia o de la técnica, relacionada con su principal o pertinente uso. Para el uso de conceptos y vocablos no expresamente definidos, o cuyos significado y aplicación ofrezcan dificultad, y para su consiguiente y apropiada interpretación, se aceptarán los conceptos homologados y las definiciones adoptadas por la International Standard Organization, (ISO).
Para la expedición de normas y estándares, y atendiendo al carácter global de los problemas que afectan el medio ambiente y los recursos naturales renovables, el Ministerio del Medio Ambiente y demás autoridades ambientales competentes, podrán sustentar sus decisiones en la experiencia o en estudios técnicos, nacionales o internacionales, de reconocida idoneidad científica, o en los que para casos similares o iguales, hayan servido de fundamento técnico para la expedición de normas o la adopción de políticas medioambientales, de reconocida eficacia en otros países.
CAPITULO II DISPOSICIONES GENERALES SOBRE NORMAS DE CALIDAD DEL AIRE, NIVELES DE
CONTAMINACION, EMISIONES CONTAMINANTES Y DE RUIDO
Artículo 3º. TIPOS DE CONTAMINANTES DEL AIRE.
Son contaminantes de primer grado, aquellos que afectan la calidad del aire o el nivel de inmisión, tales como el ozono troposférico o smog fotoquímico y sus precursores, el monóxido de carbono, el material particulado, el dióxido de nitrógeno, el dióxido de azufre y el plomo. Son contaminantes tóxicos de primer grado aquellos que emitidos, bien sea en forma rutinaria o de manera accidental, pueden causar cáncer, enfermedades agudas o defectos de nacimiento y mutaciones genéticas. Son contaminantes de segundo grado, los que sin afectar el nivel de inmisión, generan daño a la atmósfera, tales como los compuestos químicos capaces de contribuir a la disminución o destrucción de la capa estratosférica de ozono que rodea la Tierra, o las emisiones de contaminantes que aún afectando el nivel de inmisión, contribuyen especialmente al agravamiento del "efecto invernadero", o cambio climático global.
Se entiende por contaminación primaria, la generada por contaminantes de primer grado; y por contaminación secundaria, la producida por contaminantes del segundo grado. La autoridad ambiental dará prioridad al control y reducción creciente de las emisiones de estas sustancias y de los tipos de contaminación atmosférica de que trata este artículo.
Artículo 4º. ACTIVIDADES ESPECIALMENTE CONTROLADAS. Sin perjuicio de sus facultades para ejercer controles sobre cualquier actividad contaminante, se considerarán como actividades, sujetas a prioritaria atención y control por parte de las autoridades ambientales, las siguientes:
a) Las quemas de bosque natural y de vegetación protectora y demás quemas abiertas prohibidas;
b) La quema de combustibles fósiles utilizados por el parque automotor;
c) La quema industrial o comercial de combustibles fósiles;
d) Las quemas abiertas controladas en zonas rurales;
e) La incineración o quema de sustancias, residuos y desechos tóxicos peligrosos;
f) Las actividades industriales que generen, usen o emitan sustancias sujetas a los
controles del; Protocolo de Montreal, aprobado por Ley 29 de 1992;
g) Las canteras y plantas trituradoras de materiales de construcción.
Artículo 5º. DE LAS DISTINTAS CLASES DE NORMAS Y ESTÁNDARES.
Las normas para la protección de la calidad del aire son:
a) Norma de calidad del aire o nivel de inmisión;
b) Norma de emisión o descarga de contaminantes al aire;
c) Norma de emisión de ruido;
d) Norma de ruido ambiental, y
e) Norma de evaluación y emisión de olores ofensivos.
Cada norma establecerá los estándares o límites permisibles de emisión para cada contaminante, salvo la norma de evaluación de olores ofensivos, que establecerá los umbrales de tolerancia por determinación estadística.

The definitions adopted in this decree are not exhaustive, so technical terms and concepts that have not been specifically defined shall be understood in their natural sense, according to their commonly accepted meaning in the branch of science or technology related to their primary or relevant use. For the issuance of regulations and standards, and taking into account the global nature of issues affecting the environment and renewable natural resources, the Ministry of Environment and other competent environmental authorities may base their decisions on experience or scientifically recognized technical studies (national or international), or those that have served as a technical foundation in similar or equal cases for issuing regulations or adopting environmental policies known to be effective in other countries.
CHAPTER II
GENERAL PROVISIONS ON AIR QUALITY REGULATIONS, POLLUTION LEVELS, POLLUTING EMISSIONS AND NOISE POLLUTION
Article 3. TYPES OF AIR POLLUTANTS. Primary air pollutants are those that affect air quality or immission levels, such as tropospheric ozone or photochemical smog and their precursors, carbon monoxide, particulate matter, nitrogen dioxide, sulfur dioxide and lead. First-degree toxic pollutants are those that when emitted, either routinely or accidentally, can cause cancer, acute illnesses or birth defects and genetic mutations. Secondary pollutants are those which, without affecting the level of immission, cause damage to the atmosphere, such as chemical compounds capable of contributing to the decline or the destruction of the stratospheric ozone layer that surrounds the Earth, or the emissions of pollutants that affect immission levels, but also have a particular impact on the worsening of the “greenhouse effect,” or global climate change.
Primary pollution is understood as that generated by primary pollutants, and secondary pollution that generated by secondary pollutants. The environmental authorities shall give priority to the control and gradual reduction of emissions of these substances and the types of air pollution referred to in this article.
Article 4. PRIORITIZED ACTIVITIES. Without prejudice to their powers to exercise control over any polluting activity, the following shall be prioritized and subject to control by environmental authorities:
a) The burning of natural forests and protective vegetation and other prohibited open burns;
b) The burning of fossil fuels used by motor vehicles;
c) The industrial or commercial burning of fossil fuels;
d) Open controlled burns in rural areas;
e) The incineration or burning of hazardous toxic waste, residues and substances;
f) Industrial activities that generate, use or emit substances subject to controls under the Montreal Protocol, ratified by Law 29 of 1992;
g) Quarries and crushing plants for construction materials.
Article 5. DIFFERENT TYPES OF REGULATIONS AND STANDARDS. The air quality protection regulations are the following:
a) Air quality or immission levels;
b) Emission or release of pollutants into the air;
c) Noise emission;
d) Ambient noise, and;
e) Evaluation and emission of offensive odors.
Each regulation shall establish permissible emission standards or limits for each pollutant, except the for the regulation for evaluation of offensive odors, which shall establish the tolerance thresholds by statistical determination.

Paciente: FULANO DE TAL
RESUMEN CLÍNICO: Se trata de paciente masculino que fue revisado por presentar un padecimiento
caracterizado por: disminución bilateral de agudeza visual de inicio brusco secundario a la exposición de substancias químicas (insecticida del tipo Malation), dolor ocular moderado y sensación de cuerpo extraño.
Se le realizaron estudios de laboratorio y gabinete sin indicar algún tratamiento específico. En los estudios de gabinete (TAC) se observan datos de edema intracanicular bilateral y alteraciones en el trayecto de ambos nervios ópticos. En la exploración oftalomológica se encuentra:
Agudeza visual
O. derecho: cuenta dedos a 3 mts.
O. izquierdo: percibe luz Ambas valoraciones en posición compensadora de la cabeza.
Oftalmoscópicamente: Edema papilar importante con pérdida de los bordes y alteración en la emergencia de vasos, algunas microhemorragias peripapilares y en trayecto temporal inferior. Asimismo se observa edema macular bilateral más acentuado en ojo izquierdo.
Dicha valoración médica se realiza en el mes de mayo de 2004. La evolución aproximada del padecimiento es de 7 meses. Con estos datos se decide realizar exploración y descompresión del nervio óptico y canal en forma bilateral. La primera se realiza el 14 de mayo de 2004 del ojo izquierdo y la segunda el 17 de junio del mismo año. El paciente cursa con mejoría clínica y sintomática, mejorando la agudeza visual de ambos ojos. Se le realizan periódicamente estudios de campimetría y ERG, confirmándose la mejoría.
A los 6 meses se aplican desinflamatorios retrobulbares con lo cual se estabiliza la recuperación de agudeza visual y campo visual. En la última revisión en este mes se realiza nueva aplicación de medicamentos desinflamatorios retrobulbares.
En la actualidad el paciente se encuentra con agudeza visual: ojo derecho 20/40 y ojo izquierdo 20/100 con corrección óptica. Entre las posibilidades diagnósticas de este padecimiento se encuentra la neuropatía óptica secundaria a exposición a substancias químicas como el Malation.
Durante el tratamiento y procedimientos quirúrgicos, de diagnóstico y de control, el paciente ha pagado por varios conceptos la cantidad de 70,000 pesos.
El presente se expide al interesado este día 30 de enero del año 2005 para los fines que estime convenientes.

CLINICAL SUMMARY: Male patient evaluated for presenting with the following condition: bilateral loss of visual acuity with acute onset after exposure to chemical substances (Malathion insecticide), moderate eye pain, and foreign body sensation.
Laboratory and medical imaging studies were performed without indicating any specific treatment. Imaging (CT) revealed evidence of bilateral intracanalicular edema and alterations in both optic nerve pathways. The ophthalmological examination found the following:
Visual acuity
Right Eye: Counts fingers 3 meters away
Left Eye: Perceives light
Both evaluations were performed with the head in a compensatory position.
Ophthalmoscopic Exam: Significant papillary edema with border loss and changes in the emergence points of vessels, some peripapillary microhemorrhages and microhemorrhages in the inferior temporal pathway. Likewise, bilateral macular edema is observed, more pronounced in the left eye.
This medical evaluation was performed in May 2004. The approximate course of the condition was 7 months. With this information, it was decided to perform bilateral examination and decompression of the optic nerve and canal.
