"quarta vidual" (widow’s allowance)

The “quarta vidual” or Widow’s Allowance attributes to the surviving spouse the personal action to claim from the decedent’s heirs:
1. The granting in ownership of inheritance assets, or equivalent thereof in money, at the choice of the decedent’s heirs, in the manner established for the payment of the “quarta trebel·liànica” in mode of claim.
2. The proportional portion of the fruits and revenues of the inheritance perceived from the time of the death of the spouse, or the value thereof in money, except for the fruits and revenues corresponding to the first year of widowhood.
The “quarta vidual” or widow’s allowance does not confer to the surviving spouse the quality of heir of the decedent, nor the right to increase in the succession of the mentioned decedent.

As for the assets purchased by both spouses under a covenant of survival, the acquisition of the participation of the predeceased spouse shall be computed in the inheritance of the latter, for the purposes of the calculation of the legitim and, if this is the case, it shall be imputed in payment on account of the “Quarta Vidual” (or allowance to which the widow or widower is entitled, amounting to one quarter of the principal’s inheritance).
