"la donación no colacionable significa que está excluida de la masa hereditaria. Eso quiere decir que los herederos no pueden exigir al beneficiario de la donación que ésta se incluya como parte de lo que le correspondía en la herencia. Así que el beneficiario de la donación entra al reparto de la herencia en las mismas condiciones que el resto de los herederos. "

The gift need not be brought into account and set against the donee's legitima, namely an entrenched automatic entitled to an inheritance from the parents. The subcription for co. shares does not count as an 'advancement' on account of his his future inheritance which s/he can take in full.
The hotchpot rule normally applies in GB on an intestacy. So gifts recvd. lifetime have to be set against any entitlement on intestacy.
