This is about an ordinary civil trial a plaintiff intended to file in Mexico, which was originally dismissed on the grounds that the defendant's address was abroad. The plaintiff then went on to file an appeal against the rejecting ruling, which was also dismissed.
This is part of the final ruling:
... si bien el gobernado tiene a su favor el derecho de acceso a la justicia, su ejercicio no es ad libitum, esto es, a su discreción en cuanto a la elección de la FORMA y VÍA en que acude a deducir sus derechos...
