In a ‘traditional guardianship,’ the child’s guardian is a close relative of the child.
The parental responsibilities exercised by this guardian are very close to the
parental responsibilities of the child’s parents. This guarantees that the child’s
familial identity and relationships can be maintained.
The ‘Child Welfare Guardianship’ differs from the traditional guardianship. The
state takes the child into a child welfare guardianship if living with the parents
puts the child is in danger. The child taken into state care is not under the
guardianship of the authorities. If the child lives with foster parents, the exercise of
the parental responsibilities belongs to the foster parent. If the child lives in a
children’s home, the exercise of the parental responsibilities belongs to the
supervisor of the children’s home.

Family law rules state that a child older than 12 is capable of forming his or her views if there is conflict between the child and the parents regarding the child’s schooling, education or the determination of the child’s career. In this situation, the public guardianship authority will rule on the controversy.
Moreover, the child over 12 has the right to directly ask the public guardianship authority to rule on this. Similarly, if the child is over 12, she or he is to be heard in the Child Welfare mediation proceeding aimed at determining the arrangement of the contact. The public guardianship authority has the duty to hear any child under guardianship in important matters concerning the child if the child is over 12. If the proceeding is about the placement of the child, the child is to be heard and due weight should be Parental Responsibilities
given to his or her views if the child is over 14. According to the Family Act the child is to be heard even if the child is younger than 14 if it is motivated; if the child demands it himself or herself, it is always motivated.

A gyermekvédelmi törvény határozottan elkülöníti egymástól a hatósági munkát és a szolgáltatásokat. Előbbi a gyermek és a család sorsát érintő hatósági döntéseket – pl. családból való kiemelés és visszahelyezés; gyám kijelölése, döntés az örökbefogadásról - jelenti, amit a gyámhatóság (jegyző, gyámhivatal) végez; utóbbi pedig azokat a különböző típusú szolgáltatásokat, amelyeket a rászoruló családok, gyerekek igénybe vehetnek.
Ugyancsak elválasztja egymástól a gyermekvédelmi törvény a szolgáltatások két körét: a minden család számára rendelkezésre álló gyermekjóléti alapellátásokat, és a családból kiemelt gyermekek gondozást biztosító gyermekvédelmi szakellátásokat.

: Ez is jó, csak éppen nem Department (a hivatkozásban is rosszul van), mert a szakszolgálat önálló intézmény, nem pedig egy főosztály vagy más intézmény osztálya, de mivel a Department csak zárójelben szerepelt, nem része a lényegnek.

A gyámhatóság határozatával lehet a gyereket a Területi Gyermekvédelmi Szakszolgálat gondnoksága alá helyezni, amelynek vezetője a gyermek jogi gyámja (legal guardian). A gyermekvédelmi gyámot ez a szakszolgálat nevezheti ki, aki ha a szakszolgálat alkalmazottja, akkor hivatásos nevelőszülő, viszont alkalmazotti viszonya miatt nem lehet jogi gyám is. Ezért használhatjuk az institutional guardian elnevezést.

A nevelőszülőt arra az időszakra, amíg a gyermeket a saját háztartásában neveli, nevelési díj valamint ellátmány illeti meg.
A nevelési díj az öregségi nyugdíj mindenkori legkisebb összegének 120%-a, különleges szükségletű gyermek esetén 140%-a, speciális szükségletű gyermek esetén pedig 150%-a.
Az ellátmány az éves nevelési díj 25%-a, melyet a nevelési díjjal együtt havonta folyósítunk.
Ezen összegeket, valamint a gyermek után járó családi pótlékot, amit a nevelőszülő igényel meg, a gyermek megfelelő ellátására kell fordítani.
Emellett a hagyományos nevelőszülő nevelőszülői díjat, a hivatásos nevelőszülő pedig - mint a TEGYESZ alkalmazottja - munkabért kap, amelynek összegét a mindenkori költségvetési törvény tartalmazza."
Mód van több gyermek nevelésére is, de ez már hivatásos nevelőszülői jogviszony. Itt a gyermekek létszáma legalább három, illetve a saját gyermek(ek)kel együtt legfeljebb hét lehet. A hivatásos nevelőszülő a TEGYESZ alkalmazottjaként dolgozik. Az alkalmazás előfeltétele a magas színvonalú hagyományos nevelőszülői tevékenység mellett egy 300 órás tanfolyam elvégzése, ahol megszerezhető a nevelőszülői szakképesítés. Természetesen a hivatásos nevelőszülőknél előfeltétel a megfelelő nagyságú lakás, ahol a több gyermek is elhelyezhető a jogszabályi előírásoknak megfelelően.

A hagyományos nevelőszülők, akik munkájuk mellett vállalják a gyerekeket, nem fix összeget kapnak, hanem minden nevelt gyerek után havi 15 ezer forintot. Az ellátmány minden gyerek után jár, ezt a törvény szerint kizárólag az ellátására, nevelésére lehet fordítani.
