obtener o presentar una demanda o prueba

I'm assuming that "presenter una demanda" is "to file a lawsuit" here, although I'm not sure about "obtener". Is "prueba" simply "proof" or "evidence" here?

I think the source text is not worded very well. I think they probably mean "to file a claim or to submit evidence". Thanks for your help anyway.

securing or submitting a lawsuit or evidence

Many years ago when I was in a conference with the Chief Interpreter for federal court interpreters in Los Angeles, she stated that it is preferable to use the translation of "evidence" for "prueba(s)" in the legal context.

I have usually used "secure" in this context for the verb "obtener."

Hi, Ruth, my understanding is that this evidence could very well be discovery. It that is the case, it is a two-way street and therefore could be both securing or receiving as well as submitting or giving. With regard to the lawsuit, since it is against or versus such person or this person, I would assume that the meaning of securing a lawsuit means it would be submitted against the defendant or party.

I believe in American English it could be a "complaint" or in British English "particulars of claim" (as of 1999) or "statement of claim" (pre-1999).

Hi Mike, does the "obtener", ie securing go with the evidence and the "presentar" go with the lawsuit and evidence? I'm just wondering if it's possible to "secure" a lawsuit.

Hi Mike, I also have "statement of claim" and "particulars of claim" as definitions of "demanda" in my dictionary. I must admit that if it was "presenter una demanda contra" on its own I would think that it's to do with filing a lawsuit, but with the "obtener" and "evidencia" either side, it seems to be muddying the waters somewhat.
