Discussion

Stuart and Aida Nelson Sep 29, 2018:
@ Rebecca Thank you for the explanation. I believe you that parte actora is used in Spanish "sentencias de divorcio". The link did not work, cheers, Aida
Rebecca Jowers Sep 29, 2018:
@Stuart/Aida That's right, cost orders are rare in Spanish divorce proceedings. However, the standard expression for "taxation (assessment) of costs" in legal Spanish is "condena en costas", and the text to be translated concerns the taxation of costs in divorce proceedings, so "condena en costas" would be the appropriate translation. As for "parte actora", this expression is a synonym of "demandante" or "parte demandante" and is used in Spanish "sentencias de divorcio" (Here's an example: www.juntadeandalucia.es/.../BOJA17-232-00002-20973-01_00125... ) Also, as you indicate for the UK, in the US "petitioner" and "respondent" are generally used in divorce and other family proceedings, rather than plaintiff/defendant.
Stuart and Aida Nelson Sep 29, 2018:
@ Rebecca @ Joshua Do you really find 'condena en costas' in a divorce decrees? I find that very odd. I have been searching on Google but cannot find a single Spanish divorce decree with this wording.
Stuart and Aida Nelson Sep 29, 2018:
@ Joshua Thanks for the info. You live and learn :) Mexican legalese is always veryyyyyyyyyy different
Joshua Parker Sep 29, 2018:
@ Robert, @ Aida I translated a divorce judgment just the other day (from Mexico) that referred to the petitioner as the "parte actora" (and "parte demandada" for the respondent).
Stuart and Aida Nelson Sep 29, 2018:
@ Hardy - dispute -taxation of costs? Does this divorce involve disputes? I am puzzling about 'costs are taxed to the plaintiff' as also asked by Taña in her reference. Normally, the costs are established before passing the sentence and I don't know if you say 'se condena en costas' in a Spanish/S/A divorce decree.

How much does it cost to get a divorce if we both agree?

Stuart and Aida Nelson Sep 29, 2018:
@ Robert - Parties to a divorce The plaintiff or petitioner spouse files the complaint, while the other is the defendant or respondent spouse.

https://www.divorcemag.com/articles/orderly-justice-the-phas...

Petitioner vs Respondent = UK and I think USA uses 'Plaintiff vs Defendant' or probably when there has been a dispute in the divorce.

In Spanish the usual is parte demandante vs parte demandada in Spain and S/A and Peticionarios when there is a divorce on mutual consent Cheers, :)

Yes, quite right, S/A, although that can be swapped in here quite easily. Saludos!//Actually, the English here is odd too, it would normally be "petitioner".

Is this for the USA? My understanding is:

What does "...all costs of Court of said Plaintiff should be taxed against the party incurring the same" mean?
In civil lawsuits, both sides incur certain types of expenses that qualify as "taxable court costs." An example is the filing fee a plaintiff pays when he files his lawsuit. Ultimately, if he wins his lawsuit, then he'll be awarded "court costs," and the defendant would end up being forced by the court to reimburse the plaintiff for that filing fee.

Other big components of court costs are typically official court reporter transcripts.

But one side or the other has already paid these costs up front. So when cases settle by agreement, it's very common -- almost universal -- for the settlement paperwork (including dismissal orders) to provide for no one to get reimbursed for their costs.
