Arbitration appeal case.
The respondents' counsel is claiming an abuse of process, by means of some people 1) changing the nature of a trust, and an abuse of right by them 2) changing nationality, in order to hope to qualify for protection under a TBI (bilateral investment treaty). This counsel is also saying that the arbitration tribunal was right to refuse jurisdiction.
"Elle invoquait d’abord l’absence d’investissement des prétendus investisseurs en ce qu’ils n’étaient que des bénéficiaires discrétionnaires du AAA Trust et à ce titre, ne possédaient pas d’investissement au jour des prétendues violations du TBI. Elle expliquait ensuite que la transformation du AAA Trust en trust fixe constituait un abus de procédure qui privait le tribunal de sa compétence."

It's obvious what it means, but what's the best way to put it? Currently I've gone for "removed jurisdiction from the arbitration tribunal".

No harm with a literal translation, though certainly diverst or usurp could also come into the frame of *arbitral reference* - it's a tribunal, rather than an ord. court of law.
BTW, it's decline rather than refuse jurisdiction.
dejurisdictionalize : howls and squeals of protest, but perfectly feasible in US Am. jurisprudence - cut to the late and great Prof. Ronald Dworkin.

: the end result may well be same, but when the divest(ing) is the result of abuse of law, it doesn't sound right. Like saying a mugger "liberated" you from your wallet.
