O juiz considera os presuppostos formais da legitimidade e interesse processual e avalia que os fatos alegados os satisfazem em termos genéricos.
Por exemplo: para pedir uma indemnização por extravio de um bem é preciso alegar que o bem nos pertence. É a alegação deste fato que estabelece a legitimidade e interesse processual, sem os quais a ação não pode proceder.
