En el sistema argentino, el término "bajo apercibimiento de ley" implica que en caso de incumplimiento de las disposiciones establecidas se aplicará una sanción (en general de tipo pecuniaria).

Por ejemplo, si en un proceso civil, se le advierte a una de las partes de no entorpecer el proceso presentando escritos sin fundamento, bajo apercibimiento de imponérsele una multa, y la parte incumple, su incumplimiento faculta al juez a imponerle una multa

Bajo apercibimiento
Expresión judicial que advierte la aplicación de una sanción por no realizar una obligación dispuesta en una citación, notificación o mandato judicial.

Otra forma de traducirlo sería "Subject to a statutory sanction". El término "subject to" indica que el incumplimiento esta sujeto a "algo" (apercibimiento). El término "sanction" indica que tal incumplimiento acarrea una sanción y "statutory" que la ley así lo establece, es decir, que está tipificado.
