Згідно ст.420 ЦК України, винаходи, корисні моделі, промислові зразки, рацоналізаторські пропозиції, таємниці виробництва належать до об'єктів інтелектуальної власності (немайнової власності), але не до "майнового характеру", що суперечить ст.423 ЦК України.

Питання:
Колеги, по-перше З Новим Роком!
По-друге, не розумію, дивіться: "об'єктів інтелектуальної власності (немайнової власності)" як це можна взагалі перекласти? "intellectual property items (nonproperty assets)" free of "proprietary nature"? якась абракадабра виходить

Найшов у Лінгво "nonproperty right of inventor" - неимущественное право изобретателя = немайнове право винахідника
Звідси недалеко "немайнова власність" (ото ж вона й є інтелектуальна, авторська).

Нижче - лінк, де non-property ownership важко перекласти інакше, ніж "немайнова власність":

Бентежить тільки дещо розпливчата різниця між non property ownership та non proprietary ownership (останній варіант теж є в гуглі і теж особливо стосується винахідництва).

Український оригінал особливої поваги не викликає. Наприклад, важко зрозуміти ЩО САМЕ суперечить ст. 423.
Мабуть тут "власність" треба розуміти не як об"єкт, яким володіють, а як право володіння чи використання.
