الوقف التعليقى :
أناط القانون – فى غير الأحوال التى نص فيها القانون على وقف الدعوى وجوباً أو جوازاً– للمحكمة تعليق البت فى الدعوى على صدور حكم فى مسألة أخرى, أو اتخاذ إجراء معين أو تقديم دليل بذاته ترى ضرورة اتخاذه أو استيفائه. و وقف المحكمة للدعوى حتى يتخذ هذا الإجراء أو يقدم هذا الدليل، يجعل حكم الوقف قطعى فيما تضمنه من عدم جواز الفصل فى موضوع الدعوى قبل تنفيذ مقتضاه ما دامت ظروف الدعوى لم تتغير عما كانت عليه حين قضى بذلك، و ذلك بالنص عليه فى المادة129 مرافعات ( المعدلة للفقرة الثانية لنص المادة293 من قانون المرافعات القديم و التى كانت تنص على : و بمجرد زوال سبب الوقف تستأنف الدعوى بقوة القانون سيرها من النقطة التى وقفت عندها. و يقوم قلم الكتاب بتعجيلها إذا اقتضت الحال. ). م129 مرافعات: " فى غير الأحوال التى نص فيها القانون على وقف الدعوى وجوباً أو جوازاً يكون للمحكمة أن تأمر بوقفها كلما رأت تعليق حكمها فى موضوعها على الفصل فى مسألة أخرى يتوقف عليها الحكم. و بمجرد زوال سبب الوقف يكون للخصوم تعجيل الدعوى. " و لقد حذف المشرع فى المادة129 من القانون الجديد، ما كانت تنص عليه المادة293 من القانون القديم، من أن الدعوى تستأنف سيرها بقوة القانون بمجرد زوال سبب الوقف
