Ben oltre il dato linguistico, il difetto di un’univoca area di illiceità delle
condotte è altresì riconducibile all’ulteriore scelta, operata nel contesto della
Direttiva in esame, di lasciar distinta l’ipotesi di ”abuso di informazioni
privilegiate” – comprensiva delle condotte di c.d. trading (realizzata “utilizzando” le informazioni privilegiate)14 e di tuyautage (“raccomandazione o induzione di
altri alla commissione di abuso di informazioni privilegiate”), entrambe indicate
all’art.3 della Direttiva – da quella di mero tipping
