Desde el punto de vista de su régimen jurídico, la de incapacidad permanente es una prestación compleja, si bien esta condición no es una novedad en el ámbito de la Seguridad Social. Ahora bien, en materia de Seguridad Social, la complejidad de las regulaciones de una sistema, no demasiado eficiente, generando situaciones tanto de sobreprotección (la IPA) o de infraprotección (la IP total de quien no consigue encontrar un empleo acorde con su capacidad laboral residual), y funcionando a veces como prestación refugio frente a otras más exigentes.
