I am translating an article that considers the case-law behind some Court of Cassation Judgements on absent/illegitimate construction permits.

The ever reliable Wikipedia defines the Italian term as follows: "Nel diritto penale italiano, il principio di offensività afferma che non vi può essere reato senza un'offesa ad un bene giuridico, cioè ad una situazione di fatto o giuridica, protetta dall'ordinamento, modificabile oppure offendibile per effetto di un comportamento umano." https://it.wikipedia.org/wiki/Offensività

However I am unsure if there is an existing English equivalent or whether a literal/descriptive translation needs to takes its place.

Here are my attempts at something of the kind: "Offensivity principle", "Principle under Italian law requiring an offence to have been committed against a protected legal asset"
