А тут обоснованное, и смысл у них разный : ) В целом формулировка слишком русская, чтобы передавать ее буквально. Все зависит от контекста. Если со стилистической точки зрения ну совсем не привлекает "appealing court decisions to higher courts", можно было бы опустить "решений судов" (appealing to higher courts) если контекст не предполагает иных толкований. Но, опять же, вольности допустимы только если не возникает двусмысленностей.
