claimant

Explanation:
Claimant — the person making a claim. Use of the word "claimant" usually denotes that the person has not yet filed a lawsuit.

Of course, if this is about a person who suffers a loss but is not making a claim, then it may be just "injured party".

Would be nice to see a little context. Just the phrase where you plan to use the term.

neutral  Angela Greenfield: In England and Wales, the term "claimant" replaced "plaintiff" after the Civil Procedure Rules came into force on 26 April 1999. Additionally, in the US in some jurisdictions "claimant" is used in court too. So it's a BIG no to use it in insurance lingo.

-> 1. Neither "BIG", nor small "no" follows logically from the fact that a term is used in also used in court. 2. My "Explanation" is a quote from IRMI Insurance terms glossary. Somehow I suspect that they must know their terminology.
