Elle s'utilise pour indiquer qu'une personne est désignée dans un contrat ou dans une procédure, soit en demande, soit en défense, comme représentant légal, institutionnel ou contractuel d'une autre personne. On trouvera dans les jugements la phrase " Madame Durant, prise ès-qualités d' administrateur légal de ses enfants mineurs Paul et Jacqueline... " ou encore "Condamne M. La fontaine ès-qualités de Maire de la Commune de... ".

Il faut noter que c'est une indication qui n'est pas superflue. Cette mention permet en effet de vérifier si la personne qui agit dispose des pouvoirs nécessaires pour contracter, ou bien, dans le cadre d'une procédure judiciaire, si cette personne avait compétence pour prendre l'initiative d'un procès. Elle permet aussi lorsqu'un jugement est rendu contre une personne ès-qualités, de savoir que seuls les biens de la personne représentée sont susceptibles d'être saisis et vendus.

disagree  AllegroTrans: misses "attestation"; you cannot just omit it; and not really a natural use of the definite article (we would say "of translations" in English) or more correctly, "translation evaluation expert" but I still think that is incorrect
