This wording appears on a restaurant menu.
That means that if it is possible to catch fish in the sea, some seafood will be fresh otherwise it will be frozen. The possibility depends on weather or seasonal conditions (no fishing in stormy weather, some fish is only available at certain times of the year) and on fishing restrictions (e.g. it is forbidden to fish in August in my area).
There is no obligation for restaurant owners and managers to declare which laws and regulations are applied, they just have to comply with them and state if their fish is fresh or frozen on the menu.

(Cassazione 24190/2005) I ristoratori hanno l'obbligo di indicare nel menu se il pesce è surgelato, e, in mancanza di tale indicazione, rischiano una condanna per il reato di frode in commercio. Frozen/fresh This is an obligatory declaration for restaurants in Italy, in many other countries too methinks. In Italy it is considered fraud under the penal code not to declare some fish may be frozen as it all is during the August fermo pesca. Usually, restaurant owners and managers do not like to reveal that to clients. If you go to a restaurant in August, no one will warn you that most of the fish is not fresh, but they have to state it on the menu. Anyway, even frozen seafood can be of good quality
... nothing is said about this in the menu. The whole tone of the menu makes it very clear that all the fish here, fresh or frozen, is of best quality. Its freshness isn't even an issue.
Referring to your remark to Josephine's answer, please note that these restrictions and safety measures are strictly complied with in the area where I live. You will not find any fresh seafood in restaurants in August, except for farmed fish.
