w Internecie znalazlam nastepujace wyjasnienie sprawy:
"Die pVV war die schuldhafte Störung der Leistung durch den Schuldner, zumeist in Form einer Verletzung von Nebenpflichten oder Schutzpflichten, und hatte einen Anspruch auf Schadenersatz zur Folge. Sie war gewohnheitsrechtlich anerkannt. Die pVV heißt "positiv", weil der Vertrag "positiv" - das heißt trotz Erfüllung - und nicht "negativ" - also durch Nichterfüllung - verletzt wurde."
Slownik prawniczy pod redakcja Mariana Kubalicy podaje, ze polskim odpowiednikiem "pVV" jest: "nienalezyte spelnienie swiadczenia". czyli - pozytywne bo spelnione, ale nie tak jak trzeba.
Wychodzi na to, ze "Kilianka"( p. wyjasnienie Andrzeja) i Kubalica zgadzaja sie w tej kwestii.
