Me parece que si se menciona primero el cargo, luego se puede agregar solamente que se encontraba debidamente autorizado.

agree Tradjur : De acuerdo con lo de "en funciones", pero no tanto con lo de "actual", pues al menos en ESpaña, el uso de "actual" en el habla se refiere al momento de ahora, y al decir el TO "was the duly..."

Another option. Habilitado imparts a nuance that goes a bit beyond "autorizado", it means that not only he had the power but was, in a way, "licensed as", or was awarded the office of, County Clerk.
I don't disagree with "autorizado" but in this case I personally would go with "habilitado".
