В страховании ответственности: страхование, приобретаемое подрядчиком или железной дорогой от имени подрядчика (подрядчик и железная дорога выступают в качестве названных страхователей), которое обеспечивает страховую защиту интересов железной дороги на случай подлежащих возмещению убытков, возникших вследствие телесных повреждений и имущественного ущерба, понесенных гражданами, служащими железной дороги, общим подрядчиком или субподрядчиками. The Railroad Protective Liability Policy meets several important insurance needs with respect to work conducted on or near railroad tracks or railroad property. In the definition of Insured Contract contained in the Commercial General Liability (CGL) Policy, railroad sidetrack agreements are covered contracts; however, specifically excluded is any part of any contract or agreement that indemnifies a railroad for losses that result from construction or demolition within 50 feet of any railroad property, or that affects any railroad bridge, trestle, track, roadbed, tunnel, underpass or crossing. This definition also clarifies that covered contracts include an easement or license agreement, except in connection with construction or demolition operations on or within 50 feet of a railroad.

The Railroad could insure this exposure under their own insurance policies, but that may drive up the cost of the railroad's own liability insurance. In general, the Railroads have very high deductibles or retentions that may impose heavy financial obligations upon them in the event of a claim, particularly if it involves a contractor on their property. The railroad can chose to transfer its risks contractually through indemnity agreements, and also require special conditions and limits from the contractor'sown liability insurance. Under this scenario the railroad is relying solely on the contractorand the contractor's insurance to protect it. What if the contractor defaults, or has its insurance canceled, or limits through claims at other project locations. For all of the above reasons, it is best to incorporate a combination of contractual indemnification and a specific, stand-alone policy, written for the specific project that aspecific contractor will performs. The Railroad Protective Policy is the insurancemechanism that handles this liability exposure for the Railroad
