The plaintiff having brought this action for a judgment of absolute divorce on the ground of constructive abandonment or the plaintiff by the defendant and the summons bearing the notation “action for divorce” having been duly served upon the defendant personally within the time prescribed therefore by statute, and the plaintiff having duly moved on due notice of defendant to the Court at a Motion Term thereof for judgment for the relief demanded in the complaint and the said motion having regularly come on to be heard and such motion having been read and considered by me, I decide and find as stated in separate Findings of Fact and Conclusions of Law of even date herewith.
