Z chwilą zawarcia małżeństwa powstaje między małżonkami z mocy ustawy wspólność majątkowa (wspólność ustawowa) obejmująca przedmioty majątkowe nabyte w czasie jej trwania przez oboje małżonków lub przez jednego z nich (majątek wspólny). Przedmioty majątkowe nieobjęte wspólnością ustawową należą do majątku osobistego każdego z małżonków.

WEDDING PROCEDURES - MAURITIUS


The documentation outlined below will be required for civil wedding in Mauritius. Copies of these documents will have to be forwarded to the .Kreola’s office at least 4- 6 weeks prior to the arrival of the couple in Mauritius:• Passports of the couple - copies of the pages containing passport number, photo, issue/expiry dates.
• Birth certificates of the couple.
• If divorced: the former marriage certificate and divorce certificate of the couple.
• If the couple is widow/widower: the former marriage certificate and death certificate of spouse
• If the couple has changed their name by deed poll: proof is required.
• If the couple is under 18 years of age on the date of the marriage: An affidavit, granting permission for the wedding to take place, is required ( Extra Cost)
• If the couple has been adopted: an adoption document needs to be produced:

Conditions - applicable for all divorced women or widows:A wedding can only be celebrated 300 days after divorce decree/from the date of death certificate of spouse or else should be holder of a medical certificate stating no pregnancy. This medical certificate must be issued in Mauritius with an Additional cost of £20 The Registrar will use the maiden surname of the bride at the time of the celebration of marriage. It is understood that only the maiden surname will appear in the marriage certificate. Only if a.change of name has been effected through legal procedures that the new name will appear on the marriage Certificate.Any relevant documentation, which is in any language other than English or French, must be officially translated and be accompanied by the original.Original copies must be brought with couple to Mauritius.It is necessary for the couple to complete legal formalities in Port Louis at least 1 working day prior to their
wedding ceremony and this will take at least half a day to full fill the necessary formalities. We recommend the couple to be in Mauritius at least 3 days (including at least 1 working day) prior wedding. When they arrive at the hotel, the Kreola Representative will advise them of the date and time they will be picked up for the formalities. They will be driven to the Civil Status Office where one of the wedding co-ordinators will meet them and will accompany them into Port Louis to proceed with all the legal formalities. They will also have to stop at the Civil Status Office of their Hotel locality for the publication of banns and to discuss the wedding time with the Civil Status Officer.

Also note the various matrimonial systems proposed:-
1. The legal system of community of goods.
2. The legal system of separations of property.
3. A marriage settlement embodied in a notarial deed in accordance with the common wish of the future spouses.If the couple choose no. (3) above, they will have to bring along a letter drawn by their notary.

A NOTE TO HELP FUTURE SPOUSESIN CHOOSING A MATRIMONIAL SYSTEMIn accordance with section 59 of the Civil Status Amendment Act No. 30 of 1979, this note has been
prepared mainly to inform future spouses about the several matrimonial systems (hey may opt for prior to
their marriage. This information, which is being made available to them by Government, deals only with the main features and the general aspects of the different matrimonial systems being proposed. In no case, should this note be considered as a complete and full description of the legal provisions in force. Future spouses should therefore, .if they wish to have further details, consult a legal adviser.Various matrimonial systems proposed :-
The future spouses may before their marriage, choose among three matrimonial systems which are
1. The legal system of community of goods.
2. The legal system of separations of property.
3. A marriage settlement embodied in a notarial deed in accordance with the common wish of the future spouses.


1. The legal system of community of goods

The Civil Code provides for a system of legal community of goods-this means that if the future spouses do not opt for a specific matrimonial system, if they marry without stating by what matrimonial system they wish to be governed, they are deemed to have chosen the system of legal community of goods.
The legal community of goods as provided by the Civil Code is a community reduced to " acquisitions" characterized by the following features :-
(a) The main one, as regards the ownership of property between {he spouses, is the existence of a mass of property which is common to both of them and which differs from the property belonging personally to either of them.
The common property belongs in a state of in division (in co-ownership) to both spouses during the marriages. In the event of a divorce or a judicial separation the common property is shared equally between the spouses. If the marriage is dissolved by the death of one of the spouses or of both spouses me common- property is divided between the surviving spouse and the heirs of the deceased spouse or between the respective heirs of both spouses as the case may be.
The mass of the common property consists of " acquisitions II that is the whole of the property either movable or immovable acquired as from the dale of the marriage by either of the spouses and which the law does not expressly considers as personal property. (It consists mainly of property purchased with money derived from the incomes or salaries of the spouses).
Personal property includes immovable property which belonged to either of (he spouses prior to ihe manage or which accrued to that spouse by succession or donation after the date of the marriage. U will remain the exclusive property of the spouse to whom il belonged or to whom it accrued by way of inheritance or donation.
(b) Under the system of the legal community of goods the administrator of personal property differs from the administration of common property, that is :-
each spouse has the usufruct and free disposition of his/her personal property.each spouse has the power to administer the common property which has been obtained from his/her work.For example, the wife freely administer her common property which is derived from her gains emoluments, and profits whereas husband administers all the other common property. - https://www.kreola.mu/web/weddingProcedures
