(12)‘Case Management Order’ means an order made by the court which identifies the Timetablefor the Child, any delay in the proceedings and the reason for such delay and the key issues inthe proceedings and includes such of the following provisions as are appropriate to the proceedings –
(a) preliminary information
–(i) the names and dates of birth of the children who are the subject of the proceedings;
(ii) the names and legal representatives of the parties, and whether they attended the hearing;(iii) any interim orders made in respect of the children and any provisions made for therenewal of those orders;

<B>(b) any recitals that the court considers should be recorded in the order, including those relating to
–(i) any findings made by the court or agreed between the parties;
(ii) any other agreements or undertakings made by the parties;

As Table 4.9 makes clear, the prime purpose of the recitals were to set out contact arrangements. They detailed the frequency of contact with specified individuals, whether contact should be supervised or not be permitted at all. Where shared care arrangements had been agreed, they set out the detail of the days in which a child would reside in each home and who would be the main carer in the event of the parents splitting up.

The recitals to the CMO shall contain the following, which will be announced in court:

a)The main reason for the grant or refusal of any adjournment and for the grant or refusal of permission for an expert to be appointed together with a short explanation of the reason for the same and the impact which the decision will have on the welfare of the child.
b)The reasons for the Timetable for the Proceedings being extended beyond 26 weeks and the reasons for any decision which has the effect of varying or extending the Timetable (for example, a request for an adjournment, or an additional assessment or expert report which is granted) anda short explanation of the impact which the decision will have on the welfare of the child9.

The recitals to the CMO shall also contain
a) the key issues to be determined; and
b) the positions of the parties, including the child.
