La regla general, es que el acto de autoridad sea de responsabilidad del Estado, a menos que el contratista haya tomado en forma expresa sobre sí tal riesgo, que no es el caso de la especie, toda vez que de los antecedentes tenidos a la vista se desprende que no existió una cláusula expresa en la cual la empresa contratista se hiciera cargo de la fuerza mayor, por lo que no cabe entender que deba asumirla.

Does this mean "unless the contractor has expressly assumed such risk"?

The term of tomado is not included in the question but 'assumed the risk' would leave open the targetting of a subcontractor or subcontractor sub-agents.
