Hi All

I am looking for a bit of help with a legal document. The relevant section is:

......probanza que carece de valor probatorio en atención a que mediante diligencia de fecha diez de agosto de dos mil dieciséis se tuvo a la parte actora por su representación desistiéndose en su entero perjuicio de dicha probanza.

The case is about a lease which has been broken by one party. The other party has gone to court to ask for the outstanding rent and other payments. This section appears in a list of the evidence used, such as the lease contract, etc. I am struggling with the last part of the sentence, so from the point where it says "se tuvo a".

One possible reading is that the plaintiff, through its representative, is deemed to have withdrawn from that evidence to its complete detriment. However, I am not very confident that I have captured the meaning properly so other opinions would be very gratefully received.

The translation is from Mexican Spanish to US English.

The sentence is ‘en atención a que se tuvo…’ IMO some commas are missing from the source sentence

Tenerse – Tener a alguien/ estuvo presente - plaintiff and lawyer were present. They appeared in the hearing.
