Although this judgement has some defects, it does clearly establish that, once shipowners constitute a limitation fund in a convention country, their other assets are protected from proceedings to secure claims in respect of which the fund has been constituted, at least in other convention countries.....

: Optowałabym za 'securing proceedings' - chyba bardziej pasuje do kontekstu sądowego. Przy zabezpieczaniu kredytów w bankowości 'securing' używane jest na pewno.

While it may not be the best equivalent in your specific context, it is more idiomatic in US legal sources I've translated: "seek preliminary injunction against smb", etc.
