To cc in nyc Methinks that in future I will ask simple questions that return one word answers. These aree subtle differences not always easy to translate. I think Liz has come up with the best references so far, but for the moment it's time for bed. I'll look at again after some sleep, providing neighbours dog doesn't bark all night, again.

special guardian ? even "special guardian" is not the same, it's a still a guardian - albeit within a limited a limited scope:

" ... A person may also be appointed as a special guardian, having limited powers over the interests of the ward. A special guardian may, for example, be given the legal right to determine the disposition of the ward's property without being given any authority over the ward's person"

not obvious at all it doesn't seem to correspond to anything similar in UK or US.
"Power of Attorney" "Durable Power of Attorney" is not decided by court ASAK, while "la curatelle" is.

But we also have:

limited guardianship; (Scots) curatory

'Nothing similar in the US or UK':

Curatory in Scots law> 'The office of an administrator who acts for or consents to the legal actings of an incapax ( i.e. a person legally incapable of acting on his account). Thus, a curator supplements the capacity of minors by consenting to their acts.' (Butterworths Glossary of Scottish legal terms).

La curatelle est une mesure judiciaire destinée à protéger une personne majeure qui, sans être hors d'état d'agir elle-même, a besoin d'être conseillée ou contrôlée d'une manière continue dans les actes importants de la vie civile. La curatelle n'est prononcée que s'il est établi que la mesure de sauvegarde de justice serait une protection insuffisante pour la personne.

Degrés de curatelle

Il existe différents degrés de curatelle.

-- Curatelle simple

La personne accomplit seule les actes de gestion courante (dits actes d'administration ou actes conservatoires), comme la gestion du compte bancaire ou la souscription d'une assurance.

En revanche, elle doit être assistée de son curateur pour des actes plus importants (dits actes de disposition ). Par exemple, le curateur doit consentir à un emprunt.

-- Curatelle renforcée

Le curateur perçoit les ressources de la personne et règle ses dépenses sur un compte ouvert au nom de celle-ci.

-- Curatelle aménagée

Le juge peut énumérer, à tout moment, les actes que la personne peut faire seule ou non, au cas par cas.
