Italian term

interposto ed interponente

Italian to English Law/Patents Human Resources employment
The full sentence is - L’impostazione della controversia operata da controparte impone, dunque, la contestuale presenza in giudizio di tutti i tre soggetti (lavoratore, interposto e interponente) che sono parti del rapporto controverso.

Anyone sure of the English here?
Thanks

Pare che "interposto" fosse il primo datore di lavoro - un'azienda USA - e "interponente" la malcapitata consociata europea che ha ufficiosamente ereditato la lavoratrice, successivamente diventata patata bollente

primary employer and sub-employer

or contractor and sub-contractor

I know sub-employer sounds a bit strange but it does appear in some Google hits mainly involving Mexican farm labourers in the U.S.A. - e.g.

4 KudoZ points awarded for this answer. Comment: "Absolutely spot on!!! Someone had already translated "interposto" as "original employer" but I didn't like it and the dispute hinges around the legality (as Jacek suggests) of this type of situation and who the real employer is at the end of the day! party seeking mediation and mediator

Non sono sicuro ma vado dalla definizione:

interporsi
mettersi fra due contendenti per conciliarli; intercedere in favore di qualcuno.

intermediary vs. user (?)

Non sono sicuro ma mi sembra attendibile:

www.eurofound.eu.int/emire/ITALY/ INTERMEDIATIONINTHEHIRINGOFLABOUR-IT.html

LABOUR-ONLY SUBCONTRACTING
Activity involving the supplying of personnel to an entrepreneur-user by intermediaries who are employers only in a purely formal sense but do not themselves have the characteristics of a real employer (means of production, managerial structures, financial means, etc.).

L'interposto è chi presta il suo nome = intermediary

Buona fortuna!

Jacek

Mi hai messo la pulce nell\'orecchio ma il problema è che non ho il tempo di approfondire la materia.

interponente = lender of the employee? (interposing subject?)
interposto = substitute employer renting the manpower?

Isn\'t it fraud anyhow?

Dai, qual è la risposta giusta??
