Texte source - anglais Neither party shall be liable to the other for direct, indirect, incidental, consequential or punitive damages including
third parties claims. XXX’s sole liability and Customer’s sole remedy for any damages resulting from Products
manufactured by XXX, shall be limited to, at XXX’s option, the refund of the purchase price or replacement of the
Product. Customer must notify XXX of any claim relating to any Product within fifteen (15) days giving rise to such
claim. The limitations contained in this section shall apply regardless of whether the claim for damages is based on
breach of contract, breach of warranty, tort or otherwise. Beyond the limits set forth hereabove, Customer waives
any right of recourse against XXX and shall obtain from its insurers a waiver of subrogation.
XXX has taken an insurance covering any financial consequence of its civil liability. Customer undertakes to take an
appropriate insurance covering its civil liability with respect to its employees and everything located at its premises
(including the Containers rented by XXX). Each party will take out appropriate insurance coverage for its property.
Any injury of any kind caused to each parties’ employees by the Products shall be borne by their employer.

Pour tout dommage causé par des Produits fabriqués par XXX, la responsabilité civile de XXX ainsi que les compensations à la disposition du Client se limitent, à la discrétion de XXX, au remboursement du prix d’achat du Produit ou à son remplacement. Les Clients doivent communiquer à XXX toute réclamation afférente à tout Produit dans un délai de quinze jours (15) à compter des faits donnant lieu à ladite réclamation. Les limites mentionnées dans le présent article s’appliquent indépendamment du fait que la demande de dommages-intérêts soit relative à une rupture de contrat, à une rupture de garantie, à la responsabilité délictuelle ou autre. Le Client renonce à tout droit de recours à l'encontre de XXX au-delà du cadre défini ci-dessus et doit obtenir de ses assureurs une renonciation à leur droit de subrogation.
XXX a souscrit une police d'assurance couvrant toutes les conséquences pécuniaires de sa responsabilité civile. Le Client s’engage à souscrire une police d'assurance adéquate couvrant sa responsabilité civile vis-à-vis de ses employés et de l'ensemble de ce qui se trouve dans ses locaux (y compris les Bouteilles louées par XXX). Chacune des parties doit souscrire une police d'assurance appropriée couvrant ses biens. Tout type de dommage corporel infligé par les Produits aux employés de chacune des parties relève de la responsabilité de l’employeur desdits employés.
